REFUND POLICY

1. INTRODUCTION

This Refund Policy outlines the terms and conditions for refunds and cancellations for services provided by MagSway Technologies Inc. (“MagSway,” “we,” “our,” or “us”) through our platform and services (collectively, the “Platform”).

2. SUBSCRIPTION SERVICES

2.1 Monthly Subscriptions

For monthly subscription services ($99/month for Brands/Agencies, $25/month for GenAI services):

  • You may cancel your subscription at any time through your account settings or by contacting our support team.
  • Cancellations will take effect at the end of the current billing cycle.
  • No partial refunds will be issued for unused portions of the current billing cycle.

2.2 Annual Subscriptions

For annual subscription services (if applicable):

  • Cancellations requested within 14 days of purchase may receive a full refund.
  • No refunds will be issued after 14 days from the purchase date.

3. TRANSACTION-BASED SERVICES

3.1 Social Commerce Commissions

For the 10% commission on social commerce transactions:

  • Commissions are only charged when a successful sale is completed.
  • If a customer returns a product, the corresponding commission will be refunded to the appropriate parties according to our return policy timeframes.
  • Disputes regarding commissions must be submitted within 30 days of the transaction.

3.2 Creator-Brand Collaborations

For brand collaboration services:

  • Funds held in escrow for brand-creator collaborations may be refunded if:
    • The collaboration is cancelled before work begins
    • The creator fails to deliver content according to specifications
    • The brand and creator mutually agree to terminate the collaboration
  • Disputes will be reviewed by our support team on a case-by-case basis.

3.3 Mentorship Sessions

For creator-follower mentorship sessions:

  • Followers may receive a full refund if the creator cancels the session and rescheduling is not possible.
  • If a follower cancels more than 24 hours before the scheduled session, they will receive a full refund.
  • If a follower cancels less than 24 hours before the scheduled session, a 50% refund will be issued.
  • No refunds will be issued for no-shows or cancellations after the scheduled start time.

4. GENAI SERVICES

For GenAI video creation and AI agent marketplace purchases:

  • One-time GenAI services are non-refundable once processing has begun.
  • If technical issues prevent the completion of the service, we will offer a credit for a future service or a refund at our discretion.
  • AI agent purchases may be refunded within 48 hours if the agent does not function as described.

5. EXCEPTIONAL CIRCUMSTANCES

We may consider refund requests outside of these terms in exceptional circumstances, including:

  • Platform outages that significantly impact service delivery
  • Technical errors that prevent proper service utilization
  • Fraudulent activity on your account
  • Other circumstances at MagSway’s discretion

6. REFUND PROCESS

6.1 How to Request a Refund

To request a refund:

  1. Log into your MagSway account
  2. Navigate to “Billing & Payments” in your account settings
  3. Select “Request Refund” for the applicable transaction
  4. Provide the reason for your refund request

6.2 Refund Processing

  • Approved refunds will be processed using the original payment method when possible.
  • Refunds typically take 5-10 business days to appear on your statement, depending on your payment provider.
  • For payments made more than 90 days prior, refunds may be issued as platform credits.

7. LIMITATIONS AND RESTRICTIONS

7.1 Abuse Prevention

We reserve the right to deny refund requests if we detect patterns of abuse, including:

  • Repeated subscriptions and cancellations
  • Excessive refund requests
  • Evidence of platform or service misuse

7.2 Account Standing

Refunds may be denied if your account:

  • Is currently suspended for Terms of Service violations
  • Has outstanding unpaid balances
  • Is under investigation for fraudulent activity

8. CHANGES TO REFUND POLICY

We may update this Refund Policy from time to time. The updated version will be indicated by an updated “Last Updated” date. We encourage you to review this Refund Policy periodically.
